General Conditions

1. Identification of the company

Château Charles is operated by BAPO bv, with registered office at Mereldreef 37, 3140 Keerbergen, Belgium, registered with the Crossroads Bank for Enterprises under company number BE04 2513 3776.

Hereinafter referred to as “Château Charles”, “we” or “us”.

2. Scope of application

These general terms and conditions apply to every reservation and every stay at Château Charles, regardless of the booking channel (directly via the website, by phone, by e-mail, or via a booking platform). By making a reservation, the guest accepts these terms without reservation. They supplement the Cancellation and Booking Conditions (see below), which form an integral part of the agreement.

3. Definitions

  • Guest: the natural person who makes a reservation and/or stays at Château Charles.
  • Agreement: the reservation confirmation between the guest and Château Charles.
  • Stay price: the total amount stated in the confirmation for the stay.

4. Formation of the agreement

A reservation request is made without obligation. After receiving the request, Château Charles confirms availability and provides the guest with the necessary payment details. The agreement is only finally concluded upon receipt of full payment of the stay price by Château Charles, as set out in the Cancellation and Booking Conditions. Payment must be made within 48 hours of receiving the payment details. As long as this payment has not been received, Château Charles is not bound and the accommodation may be allocated to another guest. If this period expires without payment, the request automatically lapses, without any further notice being required.

Château Charles reserves the right to refuse a request, for example in case of full occupancy, doubts regarding the reliability of the request, or insufficient availability.

5. Prices

The stated prices are in euros, VAT included, unless otherwise stated. Tourist tax (if applicable in the municipality of Pepinster) is not included and is charged on site. Prices may change annually or per season; the price applicable at the time the reservation was confirmed remains valid for that reservation.

Additional services (breakfast, dinner, extra nights, activities, etc.) are stated separately and are not automatically included, unless explicitly stated in the confirmation.

6. Payment

Payment is made in accordance with the terms described in the Cancellation and Booking Conditions. Payments are made by bank transfer / Bancontact / credit card / online payment platform to account number BE64 3300 3864 4652 in the name of BAPO bv, stating the guest’s name.

7. Check-in / check-out

  • Check-in: from 2:00 PM
  • Check-out: before 11:00 AM

An earlier arrival or later departure is only possible with prior agreement and may involve an additional charge. Proof of identity may be requested upon arrival.

8. House rules and use of the accommodation

The guest undertakes to use the accommodation as a reasonably prudent person and to respect Château Charles’s house rules, including in particular:

  • The maximum permitted number of guests per room/stay may not be exceeded without prior agreement.
  • Pets are allowed subject to agreement.
  • Smoking is only permitted outside.
  • Nighttime noise and nuisance to neighbours or other guests are not permitted.
  • Damage to the accommodation, furniture or contents caused by the guest or their party will be charged to the guest.

Château Charles may, without refund, deny access to the accommodation to a guest who seriously violates the house rules, or terminate their stay.

9. Liability

Château Charles is not liable for theft, loss of, or damage to the guest’s personal belongings during the stay. Use of all facilities is at the guest’s own risk.

Château Charles’s liability is in any event limited to the amount of the stay price paid, except in the case of intent or gross negligence.

10. Force majeure

In the event of force majeure (including, but not limited to, natural disasters, government measures, pandemics, fire or serious technical defects) that makes the stay impossible, Château Charles will notify the guest as soon as possible and will jointly seek a solution (rescheduling of the stay, refund, or voucher), without the guest being entitled to any additional compensation.

11. Complaints

Complaints about the stay should be reported as soon as possible, preferably on site, so that Château Charles has the opportunity to offer a solution. Complaints reported only after the stay can be submitted in writing to max@chateaucharles.be within 14 days after the end of the stay.

12. Processing of personal data

Château Charles processes the guest’s personal data (name, address, contact details, payment data) solely for the purposes of the reservation, the performance of the agreement and, where applicable, legal obligations (such as the police register). This data is not disclosed to third parties, except where legally required.

13. Applicable law and competent court

This agreement is exclusively governed by Belgian law. Any dispute that cannot be settled amicably falls under the exclusive jurisdiction of the courts of the judicial district of Leuven, division of Aarschot.

14. Amendment of the terms

Château Charles reserves the right to amend these general terms and conditions at any time. The applicable terms are those in force at the time the reservation was confirmed.
